“You” / “your” / “yours” / “customer” means a natural person who has opened an account on Paycot.com and has agreed to all terms and conditions of Paycot.com, and wants to use the Services available on the Platform.
“Paycot” means RENOBUILD GROUP SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, a limited liability company (registration No. 0001025475) incorporated in Poland, address: EMILII SCZANIECKIEJ, No.1, Apt./Office 15,kod 60-215, poczta Poznań, kraj POLSKA.
“Transaction” means: 1) your purchase of cryptocurrency from Paycot.com; 2) sale of your cryptocurrency to Paycot. Each Transaction is a two-party transaction between you and Paycot. The list of available cryptocurrencies is present on Paycot.com and can be amended by Paycot without prior notice.
“Services” means the services provided by Paycot: 1) selling of cryptocurrency to the customer for fiat currency; and 2) buying cryptocurrency from the customer for fiat currency. Paycot does not provide the Services to corporate customers. Paycot does not act as custodian for your funds, both crypto and fiat.
The terms and conditions below prescribes the rule of your use of services provided by Paycot on Paycot.com.
In order to open an account on Paycot.com and get access to the Services, you warrant that you: 1) are of a legal age to form a binding contract (at least 18 years old); 2) has not previously been suspended from using the Services; 3) full power and authority to use the Services; 4) you are not located in countries and territories where Paycot does not provide the Services; 5) you will not use the Services if applicable regulations in your jurisdiction prohibit you to do so.
When you open an account, you agree that you have read, fully understood, and accepted all terms and conditions of Paycot.com. Paycot has the right to change and modify terms and conditions at any time. Crucial amendments will become known to you before taking effect. Amendments to terms and conditions will come into force after being published on Paycot.com.
You confirm that the digital form of these terms and conditions are legally equal to the terms and conditions executed in a written form and signed by both parties. In case you do not agree with terms and conditions of Paycot.com, you must stop the use of Paycot.com and its Services immediately.
Paycot executes a Transaction following the instructions given to Paycot by you and all relevant security checks, as well as deduction of fees specified on Paycot.com.
Paycot does not provide consultations regarding timing of purchase, sale, and other aspects of cryptocurrency investment and trading. You are obliged to assess all risks associated with cryptocurrencies before each Transaction.
Paycot provides the Services 'as is' and 'as available' basis without any representation or warranty, whether express, implied, or statutory. Paycot does not guarantee that access to Paycot.com and the Services will aways be timely, uninterrupted and error-free. Paycot does not guarantee that each Transaction will be accepted and / or completed.
You hereby confirm that you agree that you have not relied upon any other warranties, statements and advices, with respect to the Services and how they are provided to you or other customers. You confirm that you agree that Paycot shall not be held accountable and liable for any losses or damages in relation to: 1) your decision to give access to your account on Paycot.com to third parties; 2) inaccurate or otherwise wrong cryptocurrency price information; 3) technical errors while you receive the Services.
In no event shall Paycot, its parent companies, subsidiaries and affiliates, beneficiaries, owners, shareholders, members of the board, directors, representatives, attorneys, officers, managers, employees, agents, and contractors be liable for any lost profits, decrease value or business opportunity, any loss, damage, corruption or breach of data, or any special, incidental, indirect, intangible, or similar damages, arising in connection with authorized or unauthorized use of the Services, Paycot.com and its terms and conditions, except the cases prescribed by applicable law.
You agree to indemnify and hold harmless Paycot.com, its parent companies, subsidiaries, affiliates, beneficiaries, owners, shareholders, members of the board, directors, representatives, attorneys, officers, managers, employees, agents, and contractors from and against any claims, actions, proceedings, investigations, demands, suits, costs, expenses and damages connected to (1) your use of the Services, (2) your violation of terms and conditions of Paycot.com, or (3) your violation of other instructions of Paycot.com, such as instruction and guidelines or (4) your violation of any applicable law, regulation, or rights of any third party during your use of the Services.
You confirm that Paycot is not liable for actions of third parties providing investment and financial advices to you. Paycot strongly advices you to use only cryptocurrency wallets under your direct control and not to disclose your account access and activity to third parties.
Paycot cannot be liable for delays or failures while processing Transactions due to any technical problems, including problems in the telecommunications, as well as other force majeure events, such as war, civil unrest, earthquakes, eruption, flooding etc.
Your Transaction is considered completed when:
If you buy cryptocurrency from Paycot. Paycot makes a transfer of the purchased cryptocurrency to your cryptocurrency wallet as specified in the instructions of Transaction.
If you sell cryptocurrency to Paycot. Paycot makes a transfer of fiat currency to your account as specified in the instructions of Transaction.
Please note that the return of transferred funds is not possible after the Transaction is completed. However, you may initiate another Transaction.
All customers of Paycot are subjected to security checks to verify the identity and purpose of Transactions. Paycot reserves the right to request additional documents and information from you and restrict your access to the Services until further notice. If the amount of cryptocurrency received by Paycot from you is different by more than 20% of the amount you indicate during the start of the Transaction, Paycot is in the right to unilaterally reject the Transaction.
If the amount of cryptocurrency to be sent to you is different from the market value by more than 2% from the moment of the start of the Transaction and the time the Transaction is processed, Paycot is in the right to change the amount of cryptocurrency to be paid out.
In case the cryptocurrency is returned to you or Paycot, cryptocurrency commission costs and fiat currency transfers are withheld from the currency received by Paycot from you.
Paycot has the right to temporarily hold the funds transferred by you as part of Transaction because of hacker attacks on Paycot.com, as well as in cases when an additional information is required from you in order to continue Transaction.
All information that you provide to Paycot while using the Services is confidential and won’t be transferred to the third parties, with the exception of service providers that ensures Paycot’s compliance with the relevant anti-money laundering and counter-terrorist regulations, and execution of Transactions. For that reason Paycot may share and transfer your personal information to the third parties outside the EU.
By using the Services, you agree that the liability of Paycot is limited to the funds received from you for the execution of Transaction, and Paycot does not provide additional warranty assumes no additional liability to you.
Paycot has the right to suspend your account on Paycot.com immediately for any reason including suspicions of your violation of the terms and conditions of Paycot, violation of other policies and procedures of Paycot, or applicable regulations. You have the right to terminate your account on Paycot.com at any time, with or without a particular reason.
Paycot aims to provide the Services in an efficient and professional way. Our goal is to provide informative, helpful and full information for our Customers. All Customers are in in the right to submit complain regarding the provided Services. All complaints shall be sent to [email protected]. Paycot is obliged to assess the complaint and provide response within 15 days from the day the complaint is received. Paycot record-keeping include the complaints sent by Customer for further improvement of the Services.
You agree that any disputes between you and Paycot initially shall be attempted to be resolved by mutual negotiations. In order to settle a dispute by mutual negotiations, you shall contact Paycot by email ([email protected]) and describe your issue to Paycot’s Support Department. You shall use the email that was used for your registration on Paycot.com. Your use of the Services shall be governed by and interpreted according to laws of Poland. You and Paycot shall submit to the exclusive jurisdiction of the Polish Court.
Transactions involved cryptocurrency are considered irreversible. However, you may initiate another Transaction and sell newly-purchased cryptocurrency back to Paycot and vice versa under condition, that purchase and sale of a particular cryptocurrency is available as part of the Services.
Paycot is is registered in the Virtual Currency Activity Register (Rejestr działalności w zakresie walut wirtualnych) under registration No. RDWW-1226. Paycot is supervised by the General Inspector of Financial Information (the GIFI). The GIFI is supported in realization of the tasks by the Department of Financial Information of the Ministry of Finance, which acts as the Polish Financial Intelligence Unit.
